By downloading, installing, or using the NailGlow AI mobile application, you agree to be bound by these Terms of Service. Please read these terms carefully before using our app. If you do not agree to these terms, please do not use our service.

Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and NailGlow AI. By using our app, you acknowledge that you have read, understood, and agree to be bound by these terms and our Privacy Policy. These terms apply to all users of the app, whether you use the free version or purchase a premium subscription.

Service Description

Beauty and Entertainment Purpose: NailGlow AI is a beauty and entertainment application designed for fashion, aesthetics, and cosmetic purposes only. The app allows users to read content about nail and hand fashion, beauty trends, and aesthetic styles.

Photo Analysis Features: Users may upload nail and hand photos through our Supabase or similar cloud based backend and storage system. These photos are processed using AI services (including but not limited to OpenAI) to provide beauty and aesthetic analysis. Analysis features may require subscription payment, though this is not guaranteed for all features.

Account System: Upon opening the app, users receive an anonymous user ID through Supabase. Users may choose to sign in with Google or Apple to protect their account from automatic deletion.

Third-Party Services: Our app relies on third-party AI services for analysis and recommendations. We have no control over the accuracy, appropriateness, or quality of AI-generated content. All AI responses are the responsibility of the respective service providers.

NOT MEDICAL ADVICE: This application provides no medical, health, or diagnostic advice whatsoever. All content, analysis, and recommendations are purely for beauty, fashion, and entertainment purposes. We accept NO responsibility for any health-related decisions or medical concerns.

Eligibility and Account Requirements

Age Requirements: You must be at least 13 years old to use NailGlow AI. If you are under 18 years old, you must have permission from a parent or guardian to use the app and agree to these terms. By using this app, you represent and warrant that you meet these age requirements.

Parental Consent: If you are under 18, your parent or guardian must review and agree to these terms on your behalf. Parents and guardians are responsible for monitoring their minor children's use of the app.

Account Security: You are responsible for maintaining the security of your account and for all activities that occur under your account. Anonymous accounts are created automatically through Supabase. If you choose to sign in with Google or Apple, you must comply with their respective terms of service in addition to ours.

Account Deletion: Anonymous accounts with no activity or active subscription for 90 consecutive days may be automatically deleted. Google/Apple sign-in accounts are protected from automatic deletion but can be manually deleted through the app's "Me" section or by requesting deletion with your User ID.

Accurate Information: You agree to provide accurate information when creating your account and to keep this information updated. While we collect minimal personal information, any information you do provide must be truthful.

Permitted Use

Beauty and Entertainment Use Only: NailGlow AI is intended strictly for beauty, fashion, and entertainment purposes. You may not use the app for any medical, diagnostic, health-related, or commercial purposes without explicit written permission.

Appropriate Content: When uploading photos for analysis, you must only upload appropriate images of nails and hands for beauty/aesthetic analysis. You may not upload inappropriate, offensive, medical, or unrelated content. We reserve the right to refuse service if inappropriate content is detected.

Fair Use: While we want you to get value from our AI analysis features, you agree not to abuse or overuse the service in ways that could impact performance for other users. Excessive automated requests or attempts to reverse-engineer our AI system are prohibited.

No Medical Use: You explicitly acknowledge and agree that this app provides NO medical advice, diagnosis, or health-related recommendations. You may not use the app for any health or medical purposes, and you must not interpret any analysis or content as medical advice.

Compliance with Laws: You agree to use the app in compliance with all applicable local, state, national, and international laws and regulations.

Subscription Terms

Premium Features: NailGlow AI may offer premium subscription plans that provide access to advanced features including AI nail and hand analysis, detailed beauty recommendations, aesthetic tips, and other cosmetic-related content. Feature availability and subscription requirements may change without notice.

Subscription Plans: We may offer various subscription options including monthly and annual plans. Pricing may vary by region and is subject to applicable taxes. Current pricing is displayed in the app and in your device's app store. We do not guarantee specific features will always require or not require subscription.

Free Trial: We may offer free trial periods for premium subscriptions. If you don't cancel before the trial ends, you will be automatically charged for the subscription. Trial eligibility may be limited to new users or subject to other restrictions.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price, which may differ from your original subscription price.

Payment Processing: All subscription payments are processed through your device's app store (Apple App Store or Google Play Store). We do not directly handle payment information or billing.

No Guarantee of Access: We do not guarantee that analysis features will always be available, accurate, or require subscription payment. Feature availability may change based on our operational capacity and third-party service availability.

Cancellation and Refunds

Canceling Subscriptions: You can cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period, and you will continue to have access to premium features until that time.

No Partial Refunds: We do not provide partial refunds for unused portions of subscription periods. If you cancel mid-cycle, you retain access to premium features until the end of your paid period.

App Store Refund Policy: All refund requests must be made through your device's app store, as they handle all payment processing. We follow the standard refund policies of the Apple App Store and Google Play Store.

Refund Assistance: While we cannot directly process refunds, our support team can help you understand the refund process and provide any necessary documentation to support your refund request with the app store.

Service Availability and Modifications

Service Availability: We strive to keep NailGlow AI available 24/7, but we cannot guarantee uninterrupted service. The app may be temporarily unavailable due to maintenance, updates, or technical issues beyond our control.

Feature Changes: We may modify, update, or discontinue features of the app at any time. While we try to improve the service with updates, some changes may remove or alter features you currently use.

System Requirements: The app requires compatible devices and operating systems. We may update system requirements over time, which could affect your ability to use the app on older devices.

Intellectual Property

Our Content: All content in the NailGlow AI app, including text, graphics, logos, images, software, and AI-generated recommendations, is owned by us or our licensors and is protected by copyright and other intellectual property laws.

Your Content: You retain ownership of photos you upload to the app. By uploading photos, you grant us a limited license to process and analyze them for the purpose of providing our services. Photos are deleted immediately after analysis.

Restrictions: You may not copy, modify, distribute, sell, or lease any part of our app or its content. You may not reverse engineer or attempt to extract the source code of our software.

Disclaimers and Limitations

ABSOLUTELY NO MEDICAL ADVICE: NailGlow AI provides NO medical advice, health recommendations, diagnostic information, or health-related content whatsoever. All content, analysis, and recommendations are strictly for beauty, fashion, and entertainment purposes only. We explicitly disclaim any medical accuracy or health-related utility of our service.

AI Service Responsibility: All AI-generated analysis and recommendations are provided by third-party AI services (including but not limited to OpenAI, Google, Claude, Grok). We have NO control over the accuracy, appropriateness, or quality of AI-generated content. Any errors, inappropriate responses, or inaccurate analysis are the responsibility of the respective AI service providers, not NailGlow AI. AI technology is inherently unpredictable and may produce completely inappropriate, offensive, or harmful content.

No AI Accuracy Guarantee: Artificial Intelligence systems are experimental technology that may produce completely wrong, inappropriate, biased, or harmful results. We make absolutely no warranties about AI accuracy, appropriateness, or safety. Users must exercise their own judgment and cannot rely on AI results for any important decisions.

Professional Consultation: For ANY concerns about nail health, infections, skin conditions, or other medical issues, you MUST consult with qualified healthcare professionals or dermatologists. Our app cannot and does not replace professional medical evaluation. You are solely responsible for all health-related decisions and seeking appropriate medical care.

Accuracy Disclaimer: AI technology is inherently imperfect and may produce errors, inconsistencies, offensive content, or completely inappropriate suggestions. Results may vary dramatically, and we make NO warranties regarding the accuracy, reliability, appropriateness, or effectiveness of any content or recommendations provided by the app or third-party AI services.

Service "As Is": The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, appropriate, or completely functional at all times.

User Responsibility: You acknowledge and agree that you are solely responsible for your use of the app, any decisions you make based on the app's content, and any consequences that may arise from such use. You agree to use the app entirely at your own risk and to exercise your own judgment regarding any content or information provided. You understand that AI responses may be inappropriate or harmful.

Third-Party Service Disclaimer: We are not responsible for any errors, outages, inappropriate content, or issues arising from third-party services including but not limited to OpenAI, Supabase, or any other AI or infrastructure providers we utilize.

Limitation of Liability

No Liability for Damages: To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from or relating to your use of or inability to use the app, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Maximum Liability: Our total liability to you for any and all claims arising from or relating to these terms or your use of the app shall not exceed the total amount you paid for premium subscriptions in the 12 months immediately preceding the claim, or $10 USD, whichever is less.

User Responsibility and Assumption of Risk: You acknowledge that you use the app entirely at your own risk and that you are solely responsible for any and all decisions you make based on the app's recommendations, content, or functionality. You assume all risks associated with your use of the app and agree that we shall have no responsibility or liability for any consequences arising from your use of the service.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, internet outages, or third-party service disruptions.

Termination

Termination by You: You may stop using the app and delete your account at any time through the app settings or by contacting our support team.

Termination by Us: We may suspend or terminate your access to the app if you violate these terms, engage in inappropriate behavior, or for any other reason at our discretion.

Effect of Termination: Upon termination, your right to use the app ceases immediately. Any data associated with your account will be deleted in accordance with our Privacy Policy.

Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our service, legal requirements, or business practices. When we make changes, we will update the "last modified" date and notify users through the app or other appropriate means. Continued use of the app after changes constitutes acceptance of the new terms.
